Chairman Marco called the meeting to order at 7:31.

PZC2015-8 Application to Amend Special Permit and Site plan for changes made to curb cut and driveway at 333 River Road (Map 30 Lot 17 Zone DC) Owner: B & M Realty Trust, LLC Applicant: Toudis, LLC C/O Dimitrios Moutoudis (Received February 17, 2015 P.H. by April 7, 2015 Decision within 65 days after close of P.H.)

Chairman Marco explained that the Commission had approved the original application and now the DOT has required them to modify the access. He said he believes it is a minor modification therefore no need for a Public Hearing.  The Commission was in agreement.

David Held, of Provost & Rovero, was present for the applicant.  He said when they applied for the Encroachment Permit, the DOT wanted changes as they were concerned about the site line.  He said the driveway in question is the curb cut of Route 32.  Mr. Held said there will be in and out access on Route 32 but a right turn only; right turn in and right turn out, no left turn heading north on Route 32.  He said they have also added an elongated island on Route 32.  Mr. Held presented the plans and a brief discussion was held.  

E. Standish motioned to approve PZC2015-8.  D. Roberts seconded the motion.  All in favor.  Motion carried.

PZC2015-9 Request for approval of Landscaping, signage and lighting at 333 River Road
(Map 30 Lot 17 Zone DC) Owner: B & M Realty Trust, LLC Applicant: David J Held

David Held referenced Comments 11, 12 and 13 in the original approval and presented plans. He said they do comply with Section 4.14 regarding abutters.  A discussion was held on the residence across the intersection from the site and it was agreed that they are not an abutter.  

Mr. Held said they do comply with 13.06.04; the parking lot is screened with shrubs, the islands in the parking lot are landscaped and the Dunkin Donuts sign is mulched and landscaped.  He showed the landscaping on the approved plan and notated the landscaping schedule.  

Mr. Held said they do comply with 13.05.13; 15 feet of landscaping space between the parking lot and the building.  

A discussion was held on the landscaping bond.  He asked the Commission to empower Staff to review and approve the bond estimate.  

Mr. Held referenced the lighting legend on the plans and pointed out the areas of lighting.  He said they have provided cut sheets with the application and the lighting will be full cut-off.  He said they do not yet have a detailed lighting plan but asked the Commission to remand this to staff.  

Mr. Held said they have signage notations from the Zoning Regulations on the plans for each sign.  He said they do not have cut sheets as of yet but asked the Commission to empower Staff to review and approve the cut sheets when developed.  He added that all other signs are DOT signs.  A brief discussion was held on the Dunkin Donuts sign.

D. Roberts motioned to delegate review and approval of the landscaping (including bond), signage, and lighting to Staff.  Approval will be contingent upon review (including that the size of the signage and confirmation the lighting is dark sky compliant).  E. Standish seconded the motion.  All in favor.  Motion carried.

PZC2015-10 Amend Zoning Regulation Section 5.02.01.02 to add Section 5.02.01.01.20 ~~Keeping of pleasure horse(s), including a building to house, exercise and train the pleasure horse(s). Notwithstanding the provisions ~of Section 7.01.03 and Table 7.1 of these regulations, on a parcel containing at least four (4) acres in accordance with Section 4.04.01 of these regulations, the Commission may grant a special permit for an accessory indoor equestrian riding building and outdoor equestrian riding area not open to the general public, for the exclusive personal use of the occupants of the property, their family and friends, who must not be required or allowed to pay any fee, provided that the size of the accessory indoor equestrian riding building does not exceed the gross area of the existing dwelling on the property by three hundred percent (300%). Applicant: Earl O. and Michele A. Brancroft (Received March 3, 2015 Public Hearing by May 5, 2015 Decision within 65 days after close of P.H.)

The Commission set the Public Hearing for May 5, 2015.

PZC2015-12 Application for Special Permit to open Personal Fitness Center at 15 River Road (Map 5 Lot 3 Zone DC) Owner/Applicant: Any Moore & Alyssa Noller (Received March 17, 2015 Public Hearing by May 19, 2015 decision within 65 days after close of P.H.)

The Commission set the Public Hearing for May 5, 2015.

PZC2015-13 Pursuant to CGS 8-24 request for review and favorable consideration to create a parking area on Mason Road for access to Knowlton Talmade Trail Owner/Applicant: Town of Willington

Peter Anderson of the Conservation Commission was present.  He presented plans and said they are looking for a small cut-in off the road for parking.  It will be stone finish and he is hoping to have Public Works do it.  He said the parking along Mason Road is not great and people will feel more comfortable in having a place to pull off.  

E. Standish asked if he thought the size was adequate and he said he doesn’t know how many people will use it but this is a good place to start.  

Chairman Marco asked S. Yorgensen to draft a letter for the Commission.

E. Standish motioned to send an 8-24 Review approval letter to the Board of Selectman in favor of PZC2015-13.  D. Roberts seconded the motion.  All in favor.  Motion carried

Old Business

PZC2014-38 Amend Zoning Regulation Section 5.07.03.01 (setbacks) and allowable yards for the DCR zone in table 8.02 which are conflicting. Applicant: Willington River Corporation (Received November 18, 2014 Public Hearing January 20, 2015 P.H. closed February 3, 2015 Decision within 65 days after close of P.H.)

The Public Hearing was closed on February 3, 2015.  

N. Martin motioned to approve PZC2014-38 with the following modification:

  • Except along an abutting DCR zone or property line, no building or structure shall be located less than two hundred (200’) feet from the perimeter property line or the zone line, whichever is less; except that any use permitted in an adjoining R-80 Zone may be located in accordance with the required setbacks for that Zone.
E. Standish seconded the motion.  All in favor.  Motion carried.


Pre Application: Don Berg is requesting to speak with Board Members about using solar power at Button Hill Senior Housing.

Don Berg was present and said he is a member of the Housing Authority.  Mr. Berg presented a Preliminary Draft and a discussion was held.  He pointed out the areas where the solar panels might be placed and said there be may be some landscaping changes.  A discussion was held on adding additional outdoor shelter with possible placement of the solar panels.  A discussion was held on wind power.

E. Standish motioned to approve the minutes of February 3, 2015.  N. Martin seconded the motion. All in favor.  Motion carried.  

Staff Report and Discussion

Chairman Marco said he and Tess Gutowski went before the Board of Finance for additional funding for a part time Zoning Agent and it was apparently rejected.
